MossBossNYC General Release and Waiver of Liability Form For Moss Building Classes

This Release and Waiver of Liability (the “Release”) by the undersigned participant (the “Participant”) in favor of MossBossNYC, its officers, employees, agents, instructors, volunteers, and affiliates (collectively, “MossBossNYC”).

1. Acknowledgment of Risks 

I acknowledge that participating in a moss-building class, including but not limited to working with live plants, moss, and related materials, carries certain risks. These include, but are not limited to, allergic reactions, accidents involving tools or equipment, physical injury, property damage, and any other risks that may arise.

2. Voluntary Participation

I understand that my participation in MossBossNYC’s moss-building class is entirely voluntary. I am fully aware of the risks involved and am voluntarily choosing to participate in the activity.

3. Release and Waiver

In consideration of being allowed to participate in MossBossNYC’s moss-building class, I hereby release, waive, and discharge MossBossNYC from any and all liability, claims, demands, actions, or causes of action that may arise from my participation. I understand that this Release extends to any and all liability for personal injury, property damage, or wrongful death caused by the negligence of MossBossNYC or its representatives.

4. Assumption of Risk

I understand and acknowledge that the moss-building activities involve inherent risks, and I voluntarily assume full responsibility for any injury, loss, or damage to person or property that may occur while participating, whether caused by negligence or otherwise.

5. Indemnification

I agree to indemnify and hold harmless MossBossNYC from any and all claims, damages, losses, and expenses, including legal fees, arising from my participation in the moss-building class.

6. Health and Medical Care

I certify that I am physically capable of participating in the moss-building class and that I have no medical conditions or allergies that would pose a risk to myself or others. In the event of an injury or illness during the class, I authorize MossBossNYC to seek emergency medical treatment on my behalf if necessary. I understand that I am solely responsible for any medical costs that may arise.

7. Use of Photos and Media

I hereby grant permission to MossBossNYC to photograph and/or record video of me during the class and to use these images or recordings for marketing, promotional, or educational purposes without compensation.

8. Governing Law

This Release is governed by the laws of the State of New York, and any legal action related to this Release must be brought in the appropriate court in New York County.

9. Severability

If any part of this Release is deemed invalid or unenforceable, the remaining portions shall remain in full force and effect.

10. Entire Agreement

This Release represents the entire agreement between MossBossNYC and the Participant and supersedes any prior agreements or understandings regarding the subject matter.
